Birth Tourism is a phrase given to those who travel to another country for the purpose of giving birth in that country.

According to the Center Immigration for Studies, there are somewhere between 36-40,000 women who come to the United States each year as "tourist" for the purpose of having a baby here in the States. If the child is born here, the 14th Amendment says the child is automatically an American citizen and as a result enjoys all the rights and benefits afforded all American citizens. Originally, the 14th Amendment was intended to ensure all emancipated slaves and their families were guaranteed U.S. citizenship. Many say the women who engage in birth tourism are taking advantage of our laws and the advantages U.S. citizenship will bring their children (and ultimately them because they are allowed to stay her because their child is a U.S.

Citizen and they are the parents). Others say these women are simply using our laws as written and what they are doing is acceptable. Still others say the only ones doing wrong are the organizations (companies) that set up and sell packages that allow these women the ability to come t the U.S. for the purpose of giving birth. Birth tourism is a phenomenon wherein expectant mothers travel to another country specifically to give birth, obtaining citizenship for their child under the laws of that country. In the United States, birth tourism is particularly prevalent due to the 14th Amendment, which grants automatic citizenship to anyone born on American soil (Cruz, 2021). It is estimated that between 36,000 and 40,000 women undertake this journey to the U.S. each year (Center for Immigration Studies, 2021).
The process generally involves women entering the U.S. on a tourist visa, often facilitated by organizations or agencies that provide packages that include accommodations, medical services, and sometimes even legal advice (Kunzel, 2020). Advocates of birth tourism argue that these women are merely exercising their rights as established within U.S. law, and that the system should be amended to reflect current realities (Shen, 2019).
On the contrary, critics believe that birth tourism exploits the intent of the 14th Amendment, labeling it as a loophole that benefits foreign nationals at the expense of American resources and potentially undermines the social fabric of the country (Kinsella, 2020). Such sentiments often lead to calls for reforming or repealing the birthright citizenship policy altogether (Baker, 2022).
In weighing the pros and cons, the key advantages of birth tourism include improved socio-economic prospects for the child, potential healthcare benefits, and the opportunity for the family to live and work in the U.S. if they decide to stay (Sun, 2021). However, the concerns include the potential strain on local healthcare systems, ethical considerations surrounding the commodification of childbirth, and the long-term implications for immigration laws and citizenship rights (Reilly, 2021).
Personally, I believe that while the motivations behind birth tourism may be rooted in the desire for a better future, the process itself raises ethical questions and reveals a significant gap in the immigration system. A sensitive and balanced approach is crucial in addressing these complexities. The issues surrounding birth tourism are deeply intertwined with broader debates about immigration reform, healthcare access, and national identity, warranting careful consideration and dialogue to arrive at equitable solutions.
