The executor argued that the death of Sturgill automatically terminated the agency, and the bank, therefore, had no right to continue to cash the checks. Who is correct here? Yes if bank is found liable to state then action will be taken against the agent as all the law suggest that agent is liable to withdraw check from Sturgill account only before his death and withdrawing money after his death without any permission from bank makes him guilty.!!
