Question
The director of a drug treatment center called a physician friend and requested that he admit one of the center's patients to the hospital. The physician friend had been seriously ill and was at home recov- ering when he received the telephone call. He was in no condition to visit the patient in the hospital and conveyed that information to the director but did allow the patient to be admitted to the hospital under his name. The patient never saw the physician before she died of an undiagnosed brain abscess within a few days after admission Her father sued the physician, claiming that there was a patient physician relationship between his daughter and the physician Should the court agree with the physician or the father?Explanation / Answer
few facts in this situation is very clearly mentioned that...
1... a patient is admitted/transfered in a physician's hospital under his name...
2....patient never saw the treating physician under whom she admitted
3... most importantly ..she died after few DAYS...
so from these facts that is cleared that though the physician was so ill but he did not communicating with the patient or her father regarding the situation of the self and the patient either as he was not visited to saw the patient who was admitted under his care (his name)
now even after admission patient died undiagnosed ..NOT IN FER HOURS BUT...AFTER DAYS...
and in the mentioned DAYS...the physician never visited to the hospital to see the patient...
so in my opinion ....
court agree with thw father...
