Maria gave her boyfriend, Mark, a check, but she left the amount incomplete. The check was given as partial payment for a $2,000 loan that Mark made to Maria three months ago. The amount was left blank because Maria was in a hurry. Maria signed a blank check and told Mark to fill out the check for $500. Mark needed to make an $800 car payment, so he wrote the check for $800 and cashed it at Maria

Scenario 1:


Maria's options:

1. Ask Mark politely to return the money and settle the issue.

2. File a complaint in the court against mark.

3. Get over this incident since she had to pay him 2000 anyway.


If Maria goes to court, she might be successful to prove in court that it is a case of fraud by proving that the cheque was filled by Mark.

But she may lose the case if it is revealed that she herself asked mark to fill the cheque and she is unable to prove the amount she asked him to fill.


Yes their relationship had an influence on the case. Maria trusted mark as he was her boyfriend and thus gave him a blank cheque.

Also Mark might have filled in $800 thinking that as his girlfriend, Maria will understand his situation and thus forgive him.
