I went into business with someone and she invested 6000. I soon found out there was no way I could work with this person so I told her we were done and I would pay her her money back. I was already paying her back in increments of $500 then she filed a civil suit on me. I am almost done paying the full amount but if I am correct this should have never gone to court because I was already paying her back. My question is? Do I have to pay court costs and interst since I do not belive this was suppose to go to civil suit to begin with? I honestly think she should have never been allowed to file on me since I was already paying her back?   I think there is a law or rule that states if you are already working something out and have accepted payments it can not be filed in civil court. Am I correct? or do I owe the interest and fees?

Answer:

When she accepted the payments then in that case filing a court case is not a good option on her part. As acceptance of money means a informal agreement on her part and thus makes no room to file a cse on court of law.

In this case you can even demand for court fees and other expenses as and when court oreders.
