Scenario: An employee is hired by Dream Massage to be a massage therapist. She is hired as an independent contractor and, therefore, receives no tax withholding or employment benefits. Dream Massage requires the employee to work a set schedule, provides her clients and all her massage products, and exercises complete control over how she does her work. In addition, when the employee shows up to work the first day, she is informed by her employer she cannot wear her hijab as it violates the company's dress policy.
Create a 700- to 1,050-word report in which you examine the employment issues presented in the scenario, including the following:
Analyze whether the employee qualifies as an employee or independent contractor.
Discuss whether Dream Massage has potentially violated any employment discrimination laws.

Explanation / Answer
Dream Massage ahs hired an employee on contract basis and is termed as an independent contractor. This means that she is not entitled to receive any company benefits and withholding taxes are not received. In this case, the employee qualifies as a freelancer or an independent contractor as she is not entitled to any company benefits which means she is not a full time employee.
Dream Massage has definitley violated the employment descrimination laws because before hiring the employee the company should be aware of all the intricacies of the candidate like which religion they belong to, whats their educational qualification, their background etc. Without knowing all this, none of the employees are hired into an organsiation. Thus, after hiring the employee in an organsiation cannot restrict them from wearing their attire if not informed to the employee before hand. Moreover, if the employee is an independent contractor, the company cannot treat them as their company employee and ask them to follow the company rules and regulations.
