As Michael entered through the door, he slipped and fell in the water that had accumulated on the floor. The manager know of the weather conditions but had not posted any signs to warn customers of the water hazard. Michael injured his back as a result of the fall, and sued Brennan’s for damages.

Based on this scenario, can Brennan’s be held liable for negligence? Why or why not?

In the situation above, if Michael falls but is not injured, could Brennan’s be held liable for negligence? Why or why not?

In the situation above, if Michael falls and is injured, but it is found that he ran into the store in his bare feet, what defense (or partial defense) could the store claim if they were sued?

Explanation / Answer

According to the above scenario Brennan’s was liable for the negligence because it was their responsibility to look after the welfare of the customer. Customers are one of the important people without them any kind of business will not see the profits. If the customer was affected by the market place it was their responsibility to look after them. In some cases customers will have their own problems and they may faint at that situation market was not responsible for the customer life. But in this situation customer fell down by the negligence of the market management.

If Michael fell down but he was not injured then Brennan’s will be liable for the negligence because it was not about the customer injury it was about the customer discomfort. Michael fell down and he felt some discomfort at that situation and that was created by the store. He was not injured when he fell down if he was injured then store will face many problems legally. So, that market should first satisfy the customer with the good management and receiving then automatically market will come across the profits.

In this situation store can claim that Michael was negligible and he doesn’t noticed the rain water and ran fast into the store with his bare foot. While going to any where it most important to notify everything without noticing the water on the floor he came and fell down then how store will be sued. In this way store can claim against the Michael’s negligence.
