Question
Please No copy from any source & no handwriting
An university professor put a few journal articles on reserve in the digital library and makes them assigned reading for the class. Unfortunately, some students in the class complain that they don’t have access to the Digital Library. The professor scans them and posts them on the Black Board. The professor gives the students in the class the permission they need to access the articles.
Discuss this scenario based on the four factors of fair use of copyrighted materials need to be considered to evaluate the professor action?
Please No copy from any source & no handwriting
Explanation / Answer
Answer:
So there are four-factor by which a person can decide if the use of copyright material falls under the fair use or not and this four-factor are as follows:
So by using the above four-factor of copyright let us analyze the given scenario from which does what professor action comes under the fair use of copyright or not.
Firstly the purpose of use of the article is to just educate the student about some specific topic. So there is no bad intention in that. One of the most important things is that what is the type of copyright present in these articles such as can they be used for references or they can only be accessed by the higher authority person etc. These are the nature of the copyright and if these were implemented on the articles then this comes under the bad use of copyright.
So for this scenario, it totally depends upon the nature of the copyright if the professor is not allowed give access to the student then it comes under the unfair use if the copyrighted materials and if it is ok to give access to the student of articles then it comes under the fair use of copyright materials.
Hope this helps.....
Good Luck....!!
