You are a law enforcement official for the local city. You are assigned to interview a complainant and victim. You meet Mary X and her 14 year old daughter Rachel. Mary explains that her daughter had been sending explicit selfies to some unknown person on the internet. You ask Mary for permission to interview her daughter with Mary present. Mary gives permission and you proceed to inquire of Rachel what occurred.

You find out that Rachel was contacted by a person on the internet through Facebook and then Facebook message. That person seemed to know much about Rachel and her family. She identified herself as Lisa Smart. Lisa just chatted with Rachel and after a number of conversations and repeated requests; Rachel sent her a photo of herself in underwear. This progressed quickly as Lisa told Rachel that she had nude photos of Rachel. Lisa threatened to post them on the internet and send them to relatives and friends of Rachel if Rachel did not send photos of a more graphic and sexual nature to Lisa. Rachel complied and sent such photos.

Lisa was contacting Rachel numerous times a day for weeks. She even returned a few of the explicit phots to Rachel’s email. Lisa also sent links to porn sites and threatened to post Rachel’s photos there.

Rachel closed her Facebook account and opened another account.   Lisa contacted her on the new account and threatened to distribute the photos. Lisa told Rachel that she would stop if she would talk on Skype.   When she connected on Skype, there was a male on the other side claiming to be Lisa’s Brother Jack Sprat. He said that he would stop this if Rachel would pose in a sexually explicit manner in the Skype session. Mary walked in when this was occurring and the screen went blank. They came immediately to law enforcement. All of the facts have taken place during the month of January of this year.

CHILD PORNOGRAPHY:

A nude or partially nude image taken of a person under the age of 18 years, for a sexual purpose, is consiidered Child Pornography.. Therefore,, any person who comes into possession of nude or partially nude images of a person under the age of 18 years iis iin Possession of Child Pornography. It is illlegal to possess Chiild Pornography therefore;; pollice have the authoriity to seize any deviice that received that nude iimage, includiing cell phones.

Even though you are a Young Person withiin the meaning of the Youth Criminall Justiice Act, alll of the offences listed above are criminall offences and you coulld be charged.. IIn addiition iif you are charged and conviicted as an adult, you coulld be entered into the Ontario Sex Offender Regiistry for at lleast 10 years. If you are the recipiient of a nude iimage of another student under the age of 18 years olld,, contact the polliice and report the incident to your parents,, teacher or guidance counselor.. You wiill not be charged if the sole reason for keeping the image is for the purpose of reportiing iit to the police.. Remember, when an image is posted or distributed on theIInternet that image remains on the Internet forever.. If you post an iimage you risk makiing it accessible to anyone who wishes to sexualllly explloiit chilldren

If Student 1 and Student 2 start sendiing the images to all their friends, every friiend who receives the image and sends it to another student has committed the offence of Distribute Child Pornography. Anyone that keeps it (except for the purpose of reporting iit to the police), and who knew or ought to have known the person in the image is under the age of 18 years,, has committed the offence of Possession of Child Pornography.

Harassment:

Harassment is unwelcome conduct that is based on race, color, religion, sex (including pregnancy), national origin, age (40 or older), disability or genetic information.
