Custom Copies, Inc., prepares and sells course-packs, which contain compilations of readings for college courses. A teacher selects the readings and delivers a syllabus to the copy shop, which obtains the materials from a library, copies them, and binds the copies. Blackwell Publishing, Inc., which owns the copyright to some of the materials, filed a suit, alleging copyright infringement. [Blackwell Publishing, Inc. v. a. Custom Copies argued, in part, that creating and selling did not “distribute” the course-packs. Does a copy shop violate copyright law if it only copies materials for course-packs? Does the copying fall under the “fair use” exception? Should the court grant the defendant’s motion? Why or why not?

b. What is the potential impact if copies of a book or journal are created and sold without the permission of, and the payment of royalties or a fee to, the copyright owner? Explain.

Explanation / Answer

A. A print shop makes copies of things for a profit. they are not the ones printing the course packs and teaching the class. there is a difference between someone printing coursepacks for profit and not teaching the class, and the teacher making the course packs to use in the class. In my mind ,because the sole purpose of making the coursepack for the copy shop is for profit and not education . they are not covered under fair use and rather were neglectful and infringing the copyright.

2. Without rightfully citing, asking permission ,or paying royalities the rightful owner and creator of the copyright will not be treated fairly. it is the same as stealing, and they are not geeting the legal or ethical compensation for their work if we do not cite, ask, or pay them.
