Turning around the culture in an organization is challenging in the best of times. Doing so is even harder in a situation where discrimination is a daily occurrence. BuyItNow.com was started by two 22-year-old entrepreneurs, Dave Freidman and Jack Johnston, who saw an opportunity early in the growth of the Internet to acquire overstock and discontinued items and make them available online to the public. This approach to selling could net a nice margin for the young company since they could forego the costs associated with retail sales. At first, the primary employees of the company, along with Dave and Jack, were their fraternity brothers. As the company grew, they continued the process of hiring from among their fraternity brothers and other close friends. After all, using this approach to hiring ensured they would continue to have “like-minded” people with whom to work. Over time the company was very successful in identifying the right product mix to attract a large following. Online auctions and other marketing techniques made BuyItNow.com a popular place for shopping for many customers. The success resulted in growth in the company and the need to hire more employees. When Dave and Jack actually started advertising for employees, they developed a coding system for their receptionist to use when applicants came into the warehouse and order center to pick up an application. This coding system enabled them to know the race, approximate age, and gender of applicants. And, just to mix it up, they included a few codes for attractiveness of the female applicants. Even with the company growth, now at 30 employees, Dave and Jack had not put into place formal processes for managing their human resources. They felt they were not yet large enough to need to do so. Now, Jack, who functions as the chief operating officer, has just received a call from the regional Equal Employment Opportunity Office informing him that a charge has been filed against him for discrimination on the basis of ethnicity and age. He is completely baffled and needs to understand what has happened and what his options are to defend against this charge.

1. The US Equal Employment Opportunity Commission (EEOC) safeguards the interests of the individuals looking for employment options by preventing any kind of job discrimination at the workplace. Any kind of discrimination at the workplace based on color, caste, religion, sex is considered illegal and has punitive damages involved. Employers with atleast 15 employees are covered under the laws and regulations provided by EEOC.

In the given example, Dave and Jack are keeping a tab on the race, age and gender of the applicants. They have even discriminated the female applicants on the basis of attractiveness. This is a clear example of the violation of the rules laid down by EEOC and legal actions can be taken against Dave and Jack.

2. The company will have to prove that they were not discriminating against the employees but were keeping a tab on the age, race and gender, so that to have diversity at the workplace. However, defending their plea will be quite difficult as there is clear evidence of discrimination while there is no sign of maintaining diversity.

3. Jack and Dave need to employ standard HR practices in the company. They need to design all HR policies, aligned to the legal compliances and standards of the Government. They also need to make sure that strict adherence to the policies is being done and that there is no kind of discrimination happening in any unit or business process of the company.

4. BuyItNow.com deals with diverse set of consumers. Having a diverse workforce will help in establishing a better connect with the consumers. Employees will be able to handle the consumers well and thus the sales of the company will increase.

5. Any person, wanting to start his or her own business, must first understand the nature of job that his company will handle and thus identify the suitable set of candidates for the same. The individual needs to comply with all the rules and regulations stated under EEOC and hence can either have a lawyer for corporate guidance, or needs to be well versed with all laws and byelaws. He needs to monitor that no kind of discrimination is happening in his company and train his employees about having a transparent approach to all kinds of work in the company.
