Question

Dina v. Chris

In 2010, Chris promised his granddaughter, Dina, a new car and $40,000 in cash if she graduated from Eagle College within five years. Dina immediately enrolled at Eagle College, attended full-time for four years, and recently graduated with her degree. After the graduation ceremony ended, Dina asked Chris when he would give her the new car and the $40,000 he had promised her. Chris looked stunned and replied, “What new car and cash? I don’t remember promising you a new car and $40,000. And even if I did make such a crazy promise, it would have been a joke and it is not enforceable because we didn’t bargain for it. Regardless, I revoke any promise right now. I am not giving you a car and cash – go pester your parents.” Can Dina enforce her grandfather’s “promise”? Why or why not? What should the parties have done in this case to avoid a dispute? Discuss and explain your response in depth.
