Question
Cheap Food Stores, Inc. (Cheap Food) is a grocery store. Workers at Cheap Food belong to the Retail Clerks Union (Union). The collective bargaining agreement between Cheap Food and Union expired and despite negotiations, both parties were unable to reach an agreement. Union voted to go on strike and began picketing Cheap Food, stationing Union members in front of Cheap Food's store holding up signs saying they were on strike against Cheap Food. The Union picketers intentionally kept employees, suppliers, and customers from entering into Cheap Food's store.
(a) Is this type of picketing lawful, yes or no?
(b) Explain the reasoning behind your answer to (a).
Explanation / Answer
a. Yes, this type of picketing is lawful.
b. Picketing is lawful since it is an act of peacefull protest and people show their oppositions by gathering support fro within the organization and peacefully restricting other employees from going to work. All these actions will have to be done in a peaceful manner. If the group involved in strike involves in aggressive methods by forcibly stopping the employees from continuing their work then its against law. According to law picketing "is lawful for a person in contemplation or furtherance of a trade dispute to attend at or near his own place of work for the purpose only of peacefully obtaining or communicating information, or peacefully persuading any person not to work or to abstain from working"
