Executive Recruitmnent should not be paid for Schmidt's hiring. First of all, there is no direct linkage between Thomas Schmidt's candidature and Executiuve Recruitment. Schmidt had contacted a friend who worked for Boston Scientific for obtaining information on the vacancy. Thereafter, he appliued for the role independently and went through the selection process by himself before being hired. Executive Recruitment did not perform any of the roles that a Recruitment Consultancy firm is expected to perform. In fact, we do not have information of whether Executive Recruitment bever brought up the name of Thomas Schmidt before he was hired.
Secondly, Charles Wohltmann taled with a Boston Scientific sales representative who had no authority to accept offers for hiring employees. Thus, the sales representative could not get into any form of contract with Executive Recruitment. An oral or any other form of contract is valide only if executed by thoise in authority.
