Deceptive advertising has been the subject of controversy for many years. Some consumer advocates claim that deceptive advertisers should be sued. In contrast, others claim that potential buyers have the responsibility to research claims made by advertisers and thereafter use common sense. Depicted in the video are examples of deceptive advertisements. As a legal term, false advertising is any published advertising material that gives consumers an incorrect understanding or belief about a product offering. False advertisin is illegal , even if the misleading advertising was made by mistake.

Subway proposed measuring bread in response to a 2013 class-action lawsuit alleging Subway engaged in deceptive marketing for its 6-inch and footlong sandwiches and served consumers less food than they were paying for

According to court documents, franchisees would be required to have a measurement instrument in stores and adhere to regular compliance inspections that would comprise measuring a sampling of baked bread to ensure loaves are 12-inches

Subway explains in the settlement agreement that due to variability in food production and the baking process, it "will never be able to guarantee that each loaf of bread will always be exactly 12 inches or greater in length after baking
