The US government has considered the discrimination of people based age that is at the age of 40 and above. Normally the age discrimination can be frequently observed on labor works.

The following situations where age discrimination is acceptable:

Situation 1: When the nature of work is purely dependent on age

Reason: The employer may show discrimination of applicants based on age when the nature of work doesn’t permit aged people to the job position. In a situation like working on micro machinery may not be possible for aged persons. Example is diamond industry.

Situation 2: The regulatory requirements are directly related with age

Reason: The prevailing regulations may not permit the old people to work in companies due to various reasons. Then the employer should not allow old people for such positions otherwise it will turn out to be a legal problem to the company.
