Question
Perhaps one of the most heated debates in healthcare ethics centers around the topic of abortion. Both the ethics and the legality of partial-birth abortions have been scrutinized in recent years. Using the South University Online Library or the Internet, research and read at least two articles on court decisions that affect partial-birth abortions. Based on your readings and research, answer the following questions:
What are the arguments for abortion and against abortion? Give one example of arguments for each side based on a healthcare professional's codes of ethics of your choice.
How do the court decisions discussed in the article affect this issue? Support your argument by using an ethical theory.
When does the autonomy or privacy of the pregnant woman give way to other concerns?
Does the fetus have rights? If yes, on what ethical basis are disputes between the rights of the fetus and the rights of the pregnant woman to be settled?
Explanation / Answer
The arguments for abortion:
1) They stated a statement that the procedure is safest for women before 12 weeks of pregnancy.
2. pregnancy of unhealthy infants and the genetic disorder detection at early stages of pregnancy the mother has rights to opt for not continuing pregnancy.
For e.g: To preserve the health of mother: A mother has rights if she is not able to continue her pregnancy in a scenario that having a baby can affect her own health , it's legal to opt for discontinuation of pregnancy as per medical terms and ethics.
The arguments against abortion:
1) The people who supported ban argued that there are other procedure that is legal for abortion.
2) Opponent have a opinion that recent law will not reduce the number of abortion done because of alternate method available. Like dismembering the fetus in the uterus.
The court verdict has made it legal to discontinue pregnancy associated with mother health, health exceptional cases like genetic disorder's etc The court decision has affected this issue as initially it was invalid for opting for abortion now court has made it legal for some cases, where all rights of pregnancy are given to mother. for e.g. Giving birth to child is considered similar to giving life and religious beliefs are associated with it, but in some medical condition continuing pregnancy can be lethal for mother as well as child in that case mother has rights to opt for abortion of the fetus.
It's totally a mother decision who is carrying a baby that she is capable of giving birth to child or not. it's legal if she wants to discontinue her pregnancy as she feels health issues associated with it. As the fetus is growing under her body she has all the rights associated with the baby.
No all the rights are associated with the mother who is carrying a fetus.
