No, intellectual property rights do not constrain hardware and software development, Intellectual property rights such as copyrights are a way to protect a software such that the software belongs to the owner and any hardware belongs to a particular company. You can patent your idea about a software or use trademarks for your hardware to protect from your competitors.

No, intellectual property rights do not constrain hardware and software availability and adoption. Each software/hardware has a design patent or a trade secret law to protect the information in the patent. But the user can have the licensed version of software’s and buy hardware’s for their own use as per under the law.

Free of charge software’s are very helpful in education and research. The cost of obtaining, installing and maintain free software’s is extremely low or may be zero. These technology can be used to derive more software’s/codes/etc for research purpose without facing any intellectual property rights issues. The work can be shared and spread without any concern which would give birth to new technologies.
