Definitely the shipping company should have prevailed if these specific issues were already present during the time of receipt. Are there already filing the Complaints with Delaval from beginning they should have definitely prevailed. In this case shipping company definitely has an advantage as they cannot protect the product from engineering itself because of a manufacturing defect and regarding the contract agreement as well as the warranty aspect of the agreement the specific cases in favour of the shipping company.
