a-Mike can recover against Sam’s club under the circumstance that though Mike saw the potholes while entering the store, but potholes should be repaired immediately by Sam club. It is gross negligence of duty and the damage suffered by Mike is irreversible and has suffered serious problem with loss of vision due to the negligence of the Sam club.
b-Sam’s club can argue for their defense that though there was a pothole and it has given repair work, but Mike has seen the potholes while entering the store. He fell into pothole during exit and it was due to the negligence and carelessness of Mike. In no way Sam can be responsible for this act.
c- When Mike lose the driving license he should not have driven the car. Nancy can claim full damage from Mike due to the accident. Mike cannot provide any facts that the accident was happened due to other circumstances. Here Mike’s incident in Sam’s club and accident of Nancy has no relation.
