Can someone please help me answer the following scenario with applying and discussing legal concepts.

The Landlord of the apartment complex is sued by the following tenants. In the past seven months, neighbors of the tenant in the same apartment complex has several bad experiences. One tenant, Rob, was robbed at knife point when he was trying to unlock the front door to the apartment complex seven months ago. This tenant told the police and landlord that he could not see the perpetrator since it was night and the apartment complex is not well light. Another tenant, Sleepy, has been complaining that the tenants two doors down plays the music loud until 4 am and has people coming and going because the other tenants are a drug dealer, Cheech and Chong . Sleepy also informs the Landlord that she does not feel safe. A Third tenant, Oscar, has complained in the past to the landlord of all the broken bottles in the common area. Oscar slipped on a beer bottle and fell onto broken glass. Oscar is sure the bottles are from the crack house apartment two down from Sleepy. Oscar did not see the bottle he stepped on because it was dark and all the bushes cast shadows from the moonlight. A forth tenant, Broke, was just robbed last night. Broke called the police and informed them and the landlord of the event. Broke was walking up to the apartment complex and never saw the robber because Broke was not paying attention behind himself. Broke was simply trying to avoid the bottles on the sidewalk and avoid the pot heads coming out of Cheech and Chong’s apartment in the dark. Broke is really upset because he will not get paid until next week. The Landlord is sure he has solved the problem by turning off the water to Cheech and Chong’s apartment.

Please state what claims each of the tenants might have against the landlord and the likelihood of each tenant’s success in court and why. Also, when if ever do you think the landlord should or should have taken corrective action and why.

Explanation / Answer

The first tenant Bob can claim that no lights were provided near the apartment and hence it is very difficult during night times. But as this is the first time the landlord might only be warned to set it right. The second tenant Sleepy can claim that the neighbours are disturbing and much inconvenience is being caused and that also they deal with drugs. But the landlord has nothing to do with htis except that he did not warn the neighbours. Oscar can complain against the landlord regarding the cleanliness of the apartment and this might cause trouble as the court can go asgainst the landlord. Broke cam claim about lights and bottles and the neighbours and this will turn out to be very expensive for the lanlord because despite of giving warnings the problems are not yet solved. Stopping water supple is not the only solution. The landlord must have reacted when the first complain was given.
