Question 1
Rob is a successful local musician. He has been approached by Steve, the manager of the Fancy Hotel, to perform at the Fancy Hotel’s grand opening event. Rob and Steve meet over a coffee to discuss the details and finalise the arrangement. During the negotiations, Rob mentions that some of his equipment is currently unavailable as it is being repaired. Steve verbally assures Rob that the Hotel will provide the necessary equipment, including an amplifier. Steve then says, ‘all that you need to do is bring yourself and your guitar, we will provide everything else’. Steve then hands Rob a contract which includes the personal details of Rob and the Hotel, the date and time of the performance, and the agreed price to be paid. However, the written contract does not mention anything about the equipment. Rob then signs the contract. On the day of the performance, Rob arrives at the Fancy Hotel a few hours early to check the stage and set-up. He is shocked to see that the only equipment on the stage is a set of large speakers. There is no amplifier! Rob approaches Steve and asks him where the amplifier is. Steve responds that musicians are responsible for bringing their own equipment. Rob then says, ‘that is not what we agreed upon. You said that the Hotel would provide the amplifier’. Steve then responds, ‘there is nothing in the written contract that requires us to provide this equipment. It is your responsibility.’
Using relevant legal principles, discuss whether the Fancy Hotel is legally obligated to provide the amplifier.
