1) Yes, parents have the right to challenge the the school districts new policy. However for the court to side with the parents, parents would have to prove that the school district is trying to re-segregate schools. This would be difficult since the school policy is not yet in place so the data showing the re-segregation of the schools would not be created yet.
2) This is very unlikely since the Supreme Court banned de jure segregation in the brown case. However the school district could be participating in de facto segregation. In doing so, the school district would go back into court control until the situation was resolved again.
3)I believe the court would side with the school district initially because of the lack of evidence. If this case is brought in front of the court, The school would have to prove their decision was not made because of the race of the students. If the school can do this then the court will more than likely dismiss the case. If the data of the school district changes in the next two to three years, I could see the court overturning there decision and taking control of the school district until the segregation of schools in the district is back under control.
