Question
Newt Gingrich was a presidential candidate for the Republican Party in 2012. One of his hallmarks as a candidate was to “abolish the EPA”. His idea was to replace the EPA with what he called a new Environmental Solutions Agency (ESA). Many citizens agreed with Gingrich’s approach and he gained traction with his idea.

Respond to the following points in a single essay with continuity among topics; however, number your response to each section within the text of your essay. Maintain a professional tone. Be sure to weave cross-cutting themes of environmental law throughout your response:
(1) explain the details of Mr. Gingrich’s idea: what exactly is his proposal? How does his “Environmental Solutions Agency” differ from the Environmental Protection Agency?
(2) Newt is not a stupid man and he knows very well the implications of his proposal. He’s been around Washington for decades. So why do you think he’d make this proposal to the American people to gain political support? What type of voter/group/citizen do you think were most likely to agree with Newt’s strategy?
(3) Explain the federalization of American environmental law – discuss its history and why it was necessary. Use specific examples to support your answer properly referencing specific case studies and/or Acts/statutes (using full proper names) where you think appropriate to help make your point.
(4) Finally, close the loop on the topic by referring back to Newt’s plan – why is the development of Newt’s Environmental Solutions Agency such a bad idea based on your response to question (3). What do you think would have been the consequences if Newt had been elected president of the United States and his plan for an ESA been implemented?
